We would like to announce that DNV GL has acquired 100% ownership of the EU Notified Body DNV GL Nemko Presafe AS (Presafe), which was until today a joint-venture together with the Oslo-based testing and certification company Nemko AS.
From 20 April 2016 the new ATEX Directive 2014/34/EU is applicable for equipment and protective systems intended for use in potentially explosive atmospheres.
Directive 2014/34/EU is based on decision of the European Parliament and of the Council of 26 February 2014 and replaces the former Directive 94/9/EC.
The new directive is aligned with the “New Legislative Framework”, however there are no technical changes in the requirements to equipment.
The Essential Health and Safety Requirements in Annex II of the 94/9/EC directive have not changed, and the list of harmonized standards will still be applicable as a basis for certification In the preamble of the new directive the following statement occurs: “Experience has shown that the criteria set out in Directive 94/9/EC that conformity assessment bodies have to fulfil to be notified to the Commission are not sufficient to ensure a uniformly high level of performance of notified bodies throughout the Union”.
This indicates stronger requirements on us as a notified body. National accreditation will be one way to ensure the necessary level of confidence. DNV Nemko Presafe AS has now confirmed its accreditation according to the new directive. Existing certificates issued for the 94/9/EC directive will still be valid, and it is not required to update these certificates if there are no changes to the product. However all manufacturers have to update their EC Declarations of conformity to an EU Declaration of conformity according to the new directive. From 8 September 2017 the new list of harmonized standards (ATEX Directive 2014/34/EU) OJ C 298 of 08/09/2017 is available. According to § 183 of the ATEX Guidelines, it is the manufacturers responsibility to determine, by GAP analysis, whether changes apply to the equipment and update Declaration of Conformity (DoC). Presafe can help you with a GAP analysis in order to find out if your product meets the requirement according to correct version of the standard. We perform testing & certification when needed.
